Although originally settled in 1989, the criminal case against the Union Carbide Corporation and its subsidiaries was reinstated in the Bhopal District Court in 1991. UCC was asked to appear in court at this time but did not show up. Due to this it was acknowledged that UCC was absconding from justice. When The Dow Chemical Company officially bought UCC in 2001 it was still absconding from the Bhopal District Court. Therefore the legal case today focuses on proving the shift of criminal culpability to Dow because of its purchase of UCC's liabilities; and thereby showing a need for Dow to come to court.

 

- (2005) Chief Judicial Magistrate's Order
Chief Judicial Magistrate, Bhopal's order of January 6, 2005, requiring Dow Chemical Company USA to state why it should not be asked to present absconding accused Union Carbide Corporation in the ongoing criminal case on the December '84 disaster in Bhopal.

-  (2004) BGIA Application
Application to issue summons to Midland, Michigan, USA-based The Dow Chemical Company to produce the proclaimed accused and absconding Union Carbide Corporation before the Court of Honorable Chief Justice Magistrate, Bhopal, India.
